Introduction

By using the services that N W Car Parks Limited offer you are agreeing to the terms and conditions as set out below. If you do not agree with these terms of use, you are forbidden to use our service.


In these terms and conditions references to “NWCP”, “We”, “Our” and “Us” are references to N W Car Parks Limited, references to the “Landowner” shall be references to the leaseholder or freeholder of any given NWCP serviced car park, references to the “Payment Processor” shall be references to Ecom6 Limited.

N W Car Parks Summary

N W Car Parks Ltd is a private parking enforcement and car park management company based in the North West. We manage a number of car parks across the Lancashire area under the Terms and Conditions set by our clients and approved by the International Parking Community who are a DVLA Accredited Trade Association (ATA) representing parking operators in both the public and private sector. These consist of pay and display, employee only, and permit holders only car parks.


As members of the International Parking Community we abide by the IPC code of practice which ensures that we operate our business in a lawful, ethical and fair manner, we are also registered with the Information Commissioners Office (ICO) for data compliance purposes. Our membership with the IPC means we are able to request a vehicles registered keepers’ details from the DVLA to enforce any parking charges that remain unpaid. NWCP erect clear signage at all site we manage to ensure anyone entering the site is can read the terms of parking on the site. If the driver of the vehicle decides to breach the terms clearly stated, they will be issued with a Parking Charge Notice.

 

Liability (Damage, loss or theft)

N W Car Parks Ltd holds no liability or responsibility for any damage, loss or theft while parking on any of the sites that we operate on.

Any incidents that occur while using/parking on any site we manage must be reported to the car park/land owner, unless otherwise specified.

 

Clear Signage

All sites we operate our services on will have clearly visible signs to make you aware of the   terms and conditions of each individual site.

NWCP signage and the sites that we erect them   on are all separately audited and approved as an IPC Site prior to any parking enforcement taking place.

 

Displaying a valid pay and display ticket

When a parking charge has been issued for ‘not displaying a valid pay and display ticket’, and the photographic evidence taken at the time of issue shows that no display ticket was clearly visible on the dashboard or windscreen at the time of issue, a Parking Charge Notice will be issued for breach of the terms and conditions of the site.


We may request a copy of the valid display ticket for that parking period is provided upon an appeal being lodged, this is so we can confirm a valid ticket was indeed purchased at the time of the PCN being issued.


Upon exiting the vehicle, drivers should take a quick look from the outside of the vehicles windscreen to ensure the ticket is clearly displayed face up on the dashboard, so it can be seen by our parking attendant when patrolling the car park.

It is not the responsibility of our parking attendants to check the floors or seats of a vehicle to try to find a pay and display ticket. The signs erected on the car park clearly state that tickets must be clearly displayed.


Consideration/Grace Period

We allow drivers a 10 minute consideration period upon entering the car park to purchase a ticket/booking and park their vehicle, as well as a 10 minute grace period to leave the car park after a ticket/booking has expired

 

Permit to Park

On some sites, a permit is required to be clearly displayed on the dashboard or windscreen in order for you to park on the site, this condition will be clearly stated on the signage that is on site. If you fail to clearly display a valid permit, you will be in breach of the terms and conditions of the site and will be issued a Parking Charge Notice.

 

Upon exiting the vehicle, drivers should take a quick look from the outside of the vehicles windscreen to ensure the permit is clearly displayed face up on the dashboard, so it can be seen by our parking attendant when patrolling the car park.

 

It is not the responsibility of our parking attendants to check the floors or seats of a vehicle to try to find a permit. The signs erected on the car park clearly state that permits must be clearly displayed.


Some sites however may not require for permits to be physically displayed on the dashboard or windscreen, only that a permit is active via the sites digital whitelist (authorized list of vehicle registrations). The whitelist is linked via our parking management system ZatPark, NWCP or the landowner can authorize or remove vehicles from this list at any time.


The whitelist will also link to the sites Parkonomy logs which is a platform we offer to motorists to purchase an online booking. Therefore, if no payment has been made for an online booking or directly to NWCP for a permit, and a vehicle is parked on site without any kind of prior authorization from the land owner, a Parking Charge Notice will be issued for unauthorized parking.

 

Parking in marked bays

Any site that has marked bays, in the form of a garage, wall, posts or any painted lines to illustrate a parking bay must followed, unless otherwise specified. All sites have clear signs informing the driver of the terms and conditions of use. If you are seen to be breaching the terms and conditions of a site we operate on, you will be issued a Parking Charge Notice.


Issuing a Parking Charge Notice

If you are seen to be breaching the conditions of parking on a site we manage, which are clearly outlined on the signage, you will be issued with a Parking Charge Notice.


A PCN can be issued either by a printed ticket being affixed to your vehicles windscreen or in the form of a Notice to Keeper letter sent to the Registered Keeper of the vehicle within 14 days of the PCN being issued. We will request the Registered Keeper details from the Driver and Vehicle Licensing Agency (DVLA) if a PCN has been issued by Automated Number Plate Recognition (ANPR), Manual Warden Patrols (MNPR) or via a Self-Ticketer.


We will also request details of the Registered Keeper if you have not contacted us or made payment within 28 days from the date you were issued a windscreen PCN.


Appeals

If you feel that your Parking Charge Notice was issued unfairly, you have the option to lodge an appeal. All appeals must be sent either via email to appeals@nwcarparks.co.uk or in writing to the following address:

Please note we do not discuss appeals or decisions over the telephone, any correspondence regarding an appeal must be sent to us in writing, this is so there is a written trail of communication between both parties should the case escalate to county court proceedings.

 

When sending your appeal you must include the PCN number, your name & full address including the postcode, your vehicle registration number, the date of the contravention, the reason for your appeal and any relevant information, any copies of additional evidence you have to support your appeal and your contact telephone number & email address if relevant.

 

The amount outstanding will not increase whilst we consider your appeal. If your appeal was received within the 14 days discount payment period, the opportunity to pay the reduced charge will be extended further after the appeal decision has been provided.

 

Our appeals team will review all cases that are appealed fairly and will consider all of your comments, evidence provided and if there were any mitigating circumstances before coming to a decision. Any Parking Charge Notices that we deem to be unfair or wrongly issued will be cancelled, we will write to you to confirm that no further action will be taken and that matters are closed.


If your appeal has been rejected and you still feel that our decision is unfair, you may further appeal to the Independent Appeals Service within 21 days of your initial appeal being rejected. The IAS will then review the matter again while considering all the evidence supplied from both parties, an adjudicator will then reach a final verdict and decide if the appeal should be allowed or dismissed. Please note NWCP will automatically withdraw the option to pay the reduced charge and the full amount will become payable if your further appeal to the IAS is dismissed after 14 days.


Payment

N W Car Parks Ltd offers a number of ways to pay your Parking Charge Notice. You can pay by credit or debit card using our 24/7 automated telephone payment line or through our payment processer on the NWCP website - this ePayment web page/ portal is powered by Ecom6 and all transactions are 3D Secure 2 as per FCA regulations. NWCP do not store credit or debit card details on any of our systems or share the information with any third parties.

 

NWCP also accept payment via Cheque/Postal Order, these must be made payable to N W Car Parks Ltd and sent to:

You must ensure that the five digit Parking Charge Notice and vehicle registration number is clearly written on the reverse so the payment can be allocated to the correct case, we recommend any sending postal payments via recorded delivery.

 

Refunds

By paying a PCN we have issued, this an admission of liability and we assume you accept full responsibility for the parking charge. No refunds will be made once a payment has been made unless ordered by the courts, or if there are mitigating circumstances such as a payment has been made twice in error. If you feel the Parking Charge has been issued in error, or do not agree with the PCN then you must follow the appeals process as detailed above. Refunds of any payments will only be made if our appeals team approves an appeal.


In regards to the ticket machines on our car parks, please be aware that they do not give change which is stated on the front of the machines, therefore is it the responsibility of the driver to enter the correct money into the machine.


If an overpayment has been made because you have entered the incorrect tariff amount as displayed on the signage, we will not be able to refund the monies as there is no way to allocate coins entered in the machine to a specific individual.

 

Failure to Pay

NWCP allows up to 28 days from the date of issue to pay your Parking Charge Notice. If payment if not received within this time period, we may request the Registered Keeper details of the vehicle from the Driver and Vehicle Licensing Agency (DVLA) to begin pursuing the PCN. If no correspondence from the Keeper is received, the PCN will continue to escalate with further debt/administration charges of up to £70.00 being added to the outstanding balance.

 

Failure to then pay any outstanding charges will result in enforcement action being taken via county court proceedings which will incur further additional costs, this could potentially result in a County Court Judgment (CCJ) being entered in our favour. The judgment will then be added to the CCJ register which will have a detrimental effect on your credit score for 6 years making it difficult when applying for things such as a mortgage, credit cards etc.

 

In some cases, N W Car Parks Ltd may allow you to pay your Parking Charge Notice in instalments; however it is to our discretion how many months your instalment plan will be broken down into. We may also increase the cost of your Parking Charge Notice if we accept a monthly payment plan, and we also reserve the right to reject a plan if the amount proposed each month is too low (e.g. you offer to only pay £5.00 per month when the PCN is in its final stage of county court proceedings).

 

Please note if you do not make payment of an instalment on the agreed upon dates and three reminders have been sent to you either by email or text message, we have the right to cancel the instalment plan while making the full outstanding balance (minus any previous payments made) due at once.

 

Tariffs

N W Car Parks reserve the right to increase our parking tariffs on our car parks at any time, if we are changing the tariffs of pay and display tickets purchased from the ticket machine, we will amend the NWCP signage on site beforehand where necessary (the tariff is sometimes included on the right hand side of the larger terms and conditions signs).Where the pricing is not included on the larger terms and conditions signage, we will simply change the tariff notice on top of the ticket machine to reflect the new pricing.


However for online Parkonomy bookings, we can change these tariffs at any time without erecting or amending any formal signage, this also applies to the longer duration bookings which can be purchased online such as monthly, quarterly bookings etc.

 

Changes

N W Car Parks Ltd reserves the right to change or update these terms and conditions at any time.
